Abstract:
Through the use of Design Thinking, this chapter firstlydescribes how creative processes in organizations, expressedwithin a context of property right effervescence, require morerigorous methods for obtaining and evaluating informationthat mitigates asymmetric effects and the loss of efficiencyand effectiveness. This is because, in the development of anew product, all the initial ideation phases of Design Thinkinginvolve various types of information, objective and subjectivethat demonstrate the complexity of participation and originalityof creative processes. Then this chapter preliminarily explores three possibleprocedures that would allow the creative process to generateuseful insights, and outside this, ideas can be patented (legallyprotected) during the initial phases of design thinking. It meansthe first intersection between Design and Law. From thisperspective, rigorous product development processes createvaluable content for all types of companies (including those inthe legal and public sector) and also represent differentiatingfactors for each organization.
